The International Criminal Court expressed concern over the withdrawal of Mali, Burkina Faso, and Niger from its membership, considering this step could weaken international efforts to combat impunity and achieve justice for victims of war crimes and crimes against humanity.
The Assembly of States Parties to the International Criminal Court, the body representing member states, confirmed that it received the withdrawal decision “with concern and regret,” emphasizing that the departure of member states could negatively impact the international criminal justice system.
The Sahel countries justify their decision
The three countries, ruled by military juntas following coups between 2020 and 2023, had announced their decision to withdraw from the International Criminal Court, considering that the court has become “a tool of new colonial oppression in the hands of imperialism” and that it does not deal with international issues with equal standards.
The decision comes as part of a broader trend adopted by the Sahel Alliance countries, which include Mali, Burkina Faso, and Niger, towards reshaping their relations with international and regional institutions, following their withdrawal from the Economic Community of West African States (ECOWAS) and strengthening their security and political cooperation among themselves.
Withdrawal undermines the fight against impunity.
The International Criminal Court stressed that states withdrawing from the Rome Statute does not serve the victims of international crimes, but rather threatens joint efforts to hold those responsible for grave violations accountable, emphasizing that international cooperation remains a fundamental element in ensuring justice.
The International Criminal Court specializes in prosecuting individuals accused of genocide, war crimes, and crimes against humanity, when national judicial systems are unable or unwilling to conduct necessary trials.
Worsening security challenges in the Sahel region
This development comes at a time when the Sahel region is witnessing an escalation in armed attacks and acts of violence, which has exacerbated the humanitarian and security situations in Mali, Burkina Faso, and Niger, amid international warnings of widening instability in the region.
Observers believe that the withdrawal of the three countries from the International Criminal Court may raise questions about the future of international accountability mechanisms in the Sahel region, given the ongoing armed conflicts and security challenges facing these countries.
