Le Dr Mohamed Mahmoud Mehran, professeur de droit international public et membre des soci\u00e9t\u00e9s am\u00e9ricaine, europ\u00e9enne et \u00e9gyptienne de droit international, a salu\u00e9 la d\u00e9claration publi\u00e9e par le minist\u00e8re \u00e9gyptien des Affaires \u00e9trang\u00e8res le jeudi 21 mai 2026, qui condamne fermement l'initiative ill\u00e9gale d'ouvrir ce que l'on appelle r\u00e9gion du Somaliland<\/strong><\/a> Une pr\u00e9tendue ambassade \u00e0 J\u00e9rusalem occup\u00e9e, soulignant que la position \u00e9gyptienne refl\u00e8te un engagement ferme envers la l\u00e9gitimit\u00e9 internationale et une d\u00e9fense in\u00e9branlable de la cause palestinienne et de la souverainet\u00e9 des pays africains face \u00e0 une s\u00e9rie continue de graves violations du droit international par Isra\u00ebl.<\/p>\n

Dans des d\u00e9clarations exclusives \u00e0 Zoom Africa News, le Dr Mehran a soulign\u00e9 que la d\u00e9claration \u00e9gyptienne \u00e9tait correcte en qualifiant cette initiative de violation flagrante du droit international et des r\u00e9solutions pertinentes en mati\u00e8re de l\u00e9gitimit\u00e9 internationale, notant que la r\u00e9solution 478 du Conseil de s\u00e9curit\u00e9 de 1980 d\u00e9clarait nulle et non avenue la loi isra\u00e9lienne qui annexait J\u00e9rusalem-Est et appelait les pays ayant \u00e9tabli des missions diplomatiques \u00e0 J\u00e9rusalem \u00e0 les retirer, expliquant que l'ouverture d'une ambassade pour une r\u00e9gion s\u00e9paratiste non reconnue internationalement dans une ville occup\u00e9e constituait une double violation, combinant le non-respect du principe de non-reconnaissance de l'acquisition de territoire par la force et le m\u00e9pris de la souverainet\u00e9 d'une Somalie unifi\u00e9e.<\/p>\n

Il a expliqu\u00e9 que la reconnaissance par Isra\u00ebl du pr\u00e9tendu Somaliland en d\u00e9cembre 2025 viole l\u2019article 1 de la Charte des Nations Unies, qui affirme le principe d\u2019autod\u00e9termination, et l\u2019article 2, paragraphe 4, qui interdit le recours \u00e0 la force contre l\u2019int\u00e9grit\u00e9 territoriale ou l\u2019ind\u00e9pendance politique de tout \u00c9tat. Il a soulign\u00e9 que la R\u00e9publique f\u00e9d\u00e9rale de Somalie est un \u00c9tat souverain reconnu internationalement, membre des Nations Unies, de l\u2019Union africaine, de la Ligue arabe et de l\u2019Organisation de la coop\u00e9ration islamique depuis 1960, et que son int\u00e9grit\u00e9 territoriale ne doit pas \u00eatre compromise.<\/p>\n

Le professeur de droit international a soulign\u00e9 que la d\u00e9claration \u00e9gyptienne \u00e9tablissait un lien entre l'ouverture de la pr\u00e9tendue ambassade \u00e0 J\u00e9rusalem et la d\u00e9tention par Isra\u00ebl de la Flottille de la Libert\u00e9 ainsi que l'arrestation de 430 militants internationaux dans les eaux internationales, notant que ce lien r\u00e9v\u00e8le un comportement isra\u00e9lien r\u00e9current de m\u00e9pris du droit international et d'impunit\u00e9, expliquant que la d\u00e9tention de la flottille humanitaire transportant une aide vitale \u00e0 Gaza assi\u00e9g\u00e9e dans les eaux internationales au large de Chypre constitue un acte de piraterie maritime interdit par l'article 101 de la Convention des Nations Unies sur le droit de la mer.<\/p>\n

Il a soulign\u00e9 que l\u2019article 23 de la quatri\u00e8me Convention de Gen\u00e8ve oblige les parties au conflit \u00e0 permettre le libre passage de l\u2019aide humanitaire \u00e0 la population civile, insistant sur le fait que le refus d\u2019Isra\u00ebl d\u2019autoriser l\u2019arriv\u00e9e de 54 navires transportant de la nourriture, de l\u2019eau et des m\u00e9dicaments \u00e0 la population de Gaza, qui souffre d\u2019une famine syst\u00e9matique depuis octobre 2023, constitue le crime d\u2019utilisation de la famine comme arme de guerre, tel que stipul\u00e9 \u00e0 l\u2019article 8, paragraphe 2, clause 25 du Statut de Rome.<\/p>\n

Mehran a soulign\u00e9 que la vid\u00e9o choquante publi\u00e9e par le ministre isra\u00e9lien extr\u00e9miste de la S\u00e9curit\u00e9 nationale, Itamar Ben-Gvir, montrant des traitements d\u00e9gradants inflig\u00e9s aux d\u00e9tenus, a conduit la France, l'Italie, l'Espagne, les Pays-Bas, la Belgique et le Canada \u00e0 convoquer les ambassadeurs isra\u00e9liens pour demander des explications officielles, et l'Espagne \u00e0 exiger l'imposition de sanctions europ\u00e9ennes urgentes contre Ben-Gvir, expliquant que cela refl\u00e8te la col\u00e8re internationale croissante face \u00e0 la s\u00e9rie de violations isra\u00e9liennes en cours.<\/p>\n

Il a not\u00e9 que la d\u00e9claration \u00e9gyptienne affirmait le plein soutien de l\u2019\u00c9gypte \u00e0 l\u2019unit\u00e9 et \u00e0 la souverainet\u00e9 de la R\u00e9publique de Somalie et son rejet de toute mesure unilat\u00e9rale qui affecte l\u2019unit\u00e9 du territoire somalien ou diminue sa souverainet\u00e9, soulignant que cette position est conforme \u00e0 la d\u00e9cision de l\u2019Union africaine, qui a affirm\u00e9 le respect des fronti\u00e8res h\u00e9rit\u00e9es du colonialisme et rejet\u00e9 toute modification de celles-ci par la force, expliquant que la reconnaissance par Isra\u00ebl de la r\u00e9gion s\u00e9paratiste vise \u00e0 d\u00e9stabiliser la Corne de l\u2019Afrique et \u00e0 cr\u00e9er un point d\u2019appui strat\u00e9gique pour Isra\u00ebl dans une r\u00e9gion vitale.<\/p>\n

Le Dr Mehran a soulign\u00e9 que la position ferme de l'\u00c9gypte, exprim\u00e9e dans la d\u00e9claration officielle, constitue un mod\u00e8le d'engagement envers le droit international et la d\u00e9fense des droits des peuples vuln\u00e9rables. Il a averti que l'impunit\u00e9 persistante d'Isra\u00ebl, malgr\u00e9 les violations r\u00e9p\u00e9t\u00e9es de la Convention de Gen\u00e8ve, du droit de la mer, de la Convention de Vienne sur les relations diplomatiques et des r\u00e9solutions du Conseil de s\u00e9curit\u00e9, constitue une grave menace pour l'ensemble du syst\u00e8me juridique international.
