La Constitution occupe une place unique et prestigieuse au sein du syst\u00e8me juridique et politique ghan\u00e9en. Outre sa force juridique contraignante, elle incarne la volont\u00e9 collective, l'histoire et les aspirations du peuple ghan\u00e9en, et a contribu\u00e9 au maintien d'un syst\u00e8me d\u00e9mocratique pendant plusieurs d\u00e9cennies.<\/p>\n

Chaque ann\u00e9e, le 7 janvier, les Ghan\u00e9ens c\u00e9l\u00e8brent la Journ\u00e9e de la Constitution, un jour f\u00e9ri\u00e9 comm\u00e9morant l'adoption de la constitution de la Quatri\u00e8me R\u00e9publique en 1992, entr\u00e9e en vigueur le 7 janvier 1993.<\/p>\n

Cette c\u00e9l\u00e9bration consacre la d\u00e9mocratie et l'\u00e9tat de droit, vise \u00e0 promouvoir la connaissance constitutionnelle et co\u00efncide \u00e9galement avec l'entr\u00e9e en fonction du nouveau parlement.<\/p>\n

Journ\u00e9e de la Constitution au Ghana<\/h1>\n

Reconnaissant son importance capitale, la Journ\u00e9e de la Constitution a \u00e9t\u00e9 inscrite au calendrier des jours f\u00e9ri\u00e9s officiels du Ghana. Cependant, plusieurs ann\u00e9es apr\u00e8s son instauration, la question de sa signification pour le citoyen ghan\u00e9en moyen demeure, et c'est \u00e0 cette question que cet article tente de r\u00e9pondre.<\/p>\n

La d\u00e9mocratie au Ghana<\/h2>\n

L\u2019adoption de la Journ\u00e9e de la Constitution n\u2019\u00e9tait pas arbitraire, car elle s\u2019appuyait sur le remarquable parcours constitutionnel entrepris par le Ghana sous la Constitution de 1992, qui a conduit \u00e0 l\u2019\u00e9tablissement de la Quatri\u00e8me R\u00e9publique le 7 janvier 1993. Ce syst\u00e8me constitutionnel a permis la plus longue p\u00e9riode continue de r\u00e9gime d\u00e9mocratique de l\u2019histoire du pays.<\/p>\n

\"\u0627\u062d\u062a\u0641\u0627\u0644\u0627\u062a<\/p>\n

L'essence m\u00eame de l'existence du Ghana est celle d'un \u00c9tat souverain et d\u00e9mocratique.<\/h3>\n

Sous la Quatri\u00e8me R\u00e9publique, le Ghana a organis\u00e9 plusieurs \u00e9lections pr\u00e9sidentielles et l\u00e9gislatives r\u00e9ussies et a connu des transitions pacifiques du pouvoir entre les deux principaux partis politiques du pays, le Congr\u00e8s national d\u00e9mocratique et le Nouveau Parti patriotique.<\/p>\n

Cette r\u00e9alisation a valu au Ghana une grande fiert\u00e9 nationale et une reconnaissance internationale en tant que d\u00e9mocratie constitutionnelle stable et havre de paix sur le continent africain. Ainsi, la Journ\u00e9e de la Constitution incarne l'essence m\u00eame de l'existence du Ghana en tant que d\u00e9mocratie souveraine. Elle c\u00e9l\u00e8bre non seulement un document, mais aussi une culture constitutionnelle qui d\u00e9fend l'\u00c9tat de droit, la responsabilit\u00e9 d\u00e9mocratique et la comp\u00e9tition politique pacifique.<\/p>\n

Malgr\u00e9 son importance, la Constitution est critiqu\u00e9e pour son accessibilit\u00e9 limit\u00e9e \u00e0 de nombreux Ghan\u00e9ens. Hormis les juristes, les fonctionnaires et une frange restreinte de la soci\u00e9t\u00e9 civile, elle est souvent per\u00e7ue comme un document juridique vague, technique ou abstrait. Ce manque de clart\u00e9 compromet l'ordre constitutionnel lui-m\u00eame, car une constitution incomprise du peuple ne peut \u00eatre d\u00e9fendue efficacement.<\/p>\n

Par cons\u00e9quent, la Journ\u00e9e de la Constitution devrait \u00eatre une occasion privil\u00e9gi\u00e9e de combler ce foss\u00e9. Cette journ\u00e9e devrait \u00eatre un moment de r\u00e9flexion civique nationale, d'\u00e9ducation et de dialogue. Les citoyens devraient comprendre non seulement leurs droits, mais aussi leurs devoirs\u00a0; non seulement les pouvoirs du gouvernement, mais aussi les limites impos\u00e9es par la Constitution.<\/p>\n

Examen constitutionnel<\/strong><\/p>\n

L\u2019engagement du Ghana en faveur du d\u00e9veloppement de sa constitution a \u00e9t\u00e9 illustr\u00e9 par la r\u00e9cente cr\u00e9ation de la Commission de r\u00e9vision constitutionnelle (CRC), pr\u00e9sid\u00e9e par le professeur Henry Kwasi Prembeh. La commission a men\u00e9 des consultations \u00e0 l\u2019\u00e9chelle nationale, examin\u00e9 l\u2019application de la constitution de 1992 apr\u00e8s des ann\u00e9es de pratique et formul\u00e9 des recommandations exhaustives, portant principalement sur des propositions de restructuration du gouvernement ghan\u00e9en.<\/p>\n

Il convient de noter que le comit\u00e9 a propos\u00e9, entre autres r\u00e9formes, d'allonger le mandat pr\u00e9sidentiel de quatre \u00e0 cinq ans et d'abolir le syst\u00e8me mixte selon lequel les membres du Parlement nomment les ministres d'\u00c9tat, dans le but de renforcer le principe de s\u00e9paration des pouvoirs.<\/p>\n

La pr\u00e9sentation et la publication du rapport du comit\u00e9 ont confirm\u00e9 une v\u00e9rit\u00e9 constitutionnelle importante\u00a0: la constitution n\u2019est pas statique, mais un instrument vivant qui peut \u00eatre r\u00e9form\u00e9 gr\u00e2ce \u00e0 la participation d\u00e9mocratique.<\/p>\n

Il est louable que le processus de r\u00e9vision actuel ait \u00e9t\u00e9 men\u00e9 \u00e0 bien d\u00e8s la premi\u00e8re ann\u00e9e de la nouvelle administration. Les recommandations du comit\u00e9 ont suscit\u00e9 des r\u00e9actions mitig\u00e9es, ce qui exige un examen attentif de la part du pr\u00e9sident avant la publication du Livre blanc. Par cons\u00e9quent, la Journ\u00e9e de la Constitution devrait rappeler aux Ghan\u00e9ens que le travail constitutionnel est un projet continu, et non une t\u00e2che achev\u00e9e.<\/p>","protected":false},"excerpt":{"rendered":"
