Khaled Aref, ambassadeur de la R\u00e9publique arabe d'\u00c9gypte au S\u00e9n\u00e9gal, a particip\u00e9 aux travaux de la Conf\u00e9rence de haut niveau sur la g\u00e9n\u00e9ralisation de la Convention permanente d'arbitrage (CPA) et de la Conf\u00e9rence de La Haye de droit international priv\u00e9 (HCCH), qui s'est tenue \u00e0 Dakar, la capitale s\u00e9n\u00e9galaise, sous le patronage du pr\u00e9sident Bassiro Faye.<\/p>\n

La conf\u00e9rence a r\u00e9uni un large \u00e9ventail de repr\u00e9sentants de gouvernements, d'organisations internationales et d'experts juridiques, o\u00f9 les participants ont discut\u00e9 des moyens de renforcer la coop\u00e9ration internationale dans les domaines de l'arbitrage, du r\u00e8glement des diff\u00e9rends et de l'harmonisation des r\u00e8gles du droit international priv\u00e9.<\/p>\n

La conf\u00e9rence constitue une plateforme importante pour l'\u00e9change d'exp\u00e9riences et de visions sur le d\u00e9veloppement des m\u00e9canismes de r\u00e8glement des diff\u00e9rends et le renforcement de la coop\u00e9ration juridique internationale, ce qui contribue \u00e0 consolider les principes de l'\u00e9tat de droit et \u00e0 soutenir la stabilit\u00e9 aux niveaux r\u00e9gional et international.<\/p>\n

La Convention permanente d'arbitrage (CPA) et la Conf\u00e9rence de La Haye de droit international priv\u00e9 (HCCH) sont deux institutions internationales importantes, la premi\u00e8re s'occupant du r\u00e8glement des diff\u00e9rends entre \u00c9tats et entit\u00e9s par l'arbitrage et la m\u00e9diation, et la seconde visant \u00e0 unifier les r\u00e8gles du droit international priv\u00e9 afin de faciliter les transactions juridiques transfrontali\u00e8res.<\/p>\n

Convention d'arbitrage permanent (CAP)<\/h3>\n

La Convention permanente d'arbitrage a \u00e9t\u00e9 inaugur\u00e9e en 1899 en vertu du premier trait\u00e9 de paix de La Haye, au Palais de la Paix de La Haye, aux Pays-Bas, pour fonctionner comme une organisation intergouvernementale, non pas comme un tribunal au sens traditionnel du terme, mais comme un organe fournissant des services de r\u00e8glement des diff\u00e9rends, et comprenant des \u00c9tats membres, des organisations intergouvernementales et des entit\u00e9s priv\u00e9es.<\/p>\n

Elle intervient dans les domaines des conflits r\u00e9gionaux et frontaliers, des questions relatives aux trait\u00e9s internationaux, des diff\u00e9rends internationaux en mati\u00e8re d'investissement et de commerce, et des questions relatives aux droits de l'homme entre \u00c9tats.<\/p>\n

La Conf\u00e9rence de La Haye de droit international priv\u00e9 (HCCH)<\/h2>\n

La Conf\u00e9rence de La Haye de droit international priv\u00e9 a \u00e9t\u00e9 cr\u00e9\u00e9e en 1893 \u00e0 l'initiative du juriste n\u00e9erlandais Tobias Asser et est devenue une organisation intergouvernementale en 1951, comptant 93 membres.<\/p>\n

La conf\u00e9rence \u0153uvre \u00e0 l'unification progressive des r\u00e8gles du droit international priv\u00e9, ayant adopt\u00e9 39 conventions et protocoles couvrant de multiples domaines, notamment le droit international de la famille (adoption, protection de l'enfance, pension alimentaire), le droit commercial international (contrats, valeurs mobili\u00e8res et finance) et la coop\u00e9ration judiciaire (transmission de documents, recueil de preuves, reconnaissance des jugements et questions de statut personnel).<\/p>\n
