Dans un nouveau d\u00e9veloppement juridique soulignant les limites des pouvoirs r\u00e9glementaires au Nig\u00e9ria, la National Broadcasting Corporation (NBC) a subi un nouveau revers juridique apr\u00e8s que la Cour d'appel de la capitale, Abuja, a rejet\u00e9 son appel visant \u00e0 annuler une d\u00e9cision ant\u00e9rieure qui l'emp\u00eachait d'imposer des sanctions financi\u00e8res aux organisations m\u00e9diatiques.<\/p>\n

La cour a rendu sa d\u00e9cision \u00e0 l'unanimit\u00e9, confirmant que le recours form\u00e9 par l'autorit\u00e9 \u00e9tait juridiquement vici\u00e9 en raison d'une erreur fondamentale dans l'identification du nom de l'appelant, ce qui a priv\u00e9 la cour de la comp\u00e9tence pour examiner le recours d\u00e8s le d\u00e9part.<\/p>\n

La d\u00e9cision a \u00e9t\u00e9 rendue en faveur de Media Rights Agenda (MRA), qui avait intent\u00e9 une action en justice pour contester les amendes de cinq millions de nairas impos\u00e9es par la National Broadcasting Authority \u00e0 un certain nombre de cha\u00eenes de t\u00e9l\u00e9vision et de plateformes de t\u00e9l\u00e9vision payante pour la diffusion de documentaires sur l'escalade de la violence et de l'ins\u00e9curit\u00e9 dans l'\u00c9tat de Zamfara.<\/p>\n

Dans sa d\u00e9cision, la juge Jane Isinanwan Anyang a soulign\u00e9 que l'avis d'appel est la pierre angulaire de toute contestation judiciaire et que tout vice substantiel dans celui-ci entra\u00eene le rejet complet de l'appel, insistant sur le fait que le tribunal ne peut exercer sa comp\u00e9tence que si les proc\u00e9dures l\u00e9gales ont satisfait correctement \u00e0 leurs exigences.<\/p>\n

L'affaire d\u00e9coule d'un arr\u00eat rendu par la Cour supr\u00eame f\u00e9d\u00e9rale en janvier 2024, qui a d\u00e9clar\u00e9 inconstitutionnelles les amendes inflig\u00e9es par l'Autorit\u00e9 nationale de la radiodiffusion \u00e0 un certain nombre d'institutions m\u00e9diatiques, dont d'importantes plateformes et cha\u00eenes de t\u00e9l\u00e9vision, consid\u00e9rant cette d\u00e9cision comme une violation de la libert\u00e9 d'expression et du droit des citoyens \u00e0 l'acc\u00e8s \u00e0 l'information.<\/p>\n

Le tribunal avait alors estim\u00e9 que l'imposition de sanctions financi\u00e8res de cette mani\u00e8re outrepassait les pouvoirs de l'organisme de r\u00e9glementation, d'autant plus que les sanctions relatives aux infractions p\u00e9nales rel\u00e8vent de la seule comp\u00e9tence des tribunaux en vertu du droit nig\u00e9rian.<\/p>\n

Cette d\u00e9cision constitue le deuxi\u00e8me revers juridique subi par l'Autorit\u00e9 nationale de la radiodiffusion cette ann\u00e9e, apr\u00e8s que la m\u00eame Cour d'appel a rejet\u00e9 en avril un autre appel interjet\u00e9 par l'Autorit\u00e9 pour annuler une d\u00e9cision ant\u00e9rieure qui affirmait que le pouvoir d'imposer des sanctions p\u00e9nales et des amendes reste le domaine exclusif du pouvoir judiciaire.<\/p>\n
