La Cour permanente d'arbitrage a d\u00e9clar\u00e9 lundi que Grande-Bretagne<\/a> Elle n'est pas tenue de verser environ 100 millions de livres sterling au Rwanda, suite \u00e0 l'annulation d'un accord pr\u00e9voyant l'expulsion de demandeurs d'asile vers ce pays d'Afrique de l'Est.<\/p>\n

L'organisme, bas\u00e9 au Palais de la Paix \u00e0 La Haye, aux Pays-Bas, a d\u00e9clar\u00e9 avoir rejet\u00e9 toutes les demandes financi\u00e8res formul\u00e9es par le Rwanda, qui affirmait que la Grande-Bretagne devait encore respecter les termes de l'accord que le Premier ministre Keir Starmer avait annul\u00e9 en 2024.<\/p>\n

Starmer a annul\u00e9 le programme d'asile \u00e9labor\u00e9 par le pr\u00e9c\u00e9dent gouvernement conservateur, en vertu duquel le gouvernement devait verser une compensation au Rwanda pour l'accueil de migrants arriv\u00e9s ill\u00e9galement en Grande-Bretagne.<\/p>\n

L'accord de r\u00e9installation des r\u00e9fugi\u00e9s entre le Royaume-Uni et le Rwanda a \u00e9t\u00e9 annul\u00e9, toutes les demandes financi\u00e8res du Rwanda ayant \u00e9t\u00e9 rejet\u00e9es.<\/figcaption><\/figure>\n

Les documents judiciaires ont montr\u00e9 que Kigali r\u00e9clamait au moins 60 millions de livres sterling (80 millions de dollars).
\nLe tribunal a d\u00e9clar\u00e9 que le panel de trois juges avait conclu \u00e0 la majorit\u00e9 que le Rwanda avait accept\u00e9 en novembre 2024, dans des notes diplomatiques, \u201c de renoncer \u00e0 tout paiement suppl\u00e9mentaire du Royaume-Uni en avril 2025 et avril 2026 \u201d.<\/p>\n

Il convient de noter que seulement 4 personnes se sont rendues volontairement au Rwanda dans le cadre de l'accord d'asile, qui a fait l'objet de contestations juridiques avant d'\u00eatre annul\u00e9.<\/p>\n

Le gouvernement rwandais a d\u00e9clar\u00e9 respecter la d\u00e9cision du tribunal, mais a ajout\u00e9 que les questions \u00e9taient complexes et sujettes \u00e0 diff\u00e9rentes interpr\u00e9tations juridiques.<\/p>\n

La porte-parole du gouvernement rwandais, Yolande Makolo, a d\u00e9clar\u00e9 dans un communiqu\u00e9 que le Rwanda continuerait de travailler de mani\u00e8re constructive avec ses partenaires internationaux, guid\u00e9 par les normes internationales et une coop\u00e9ration mutuellement avantageuse.<\/p>\n

Un porte-parole du gouvernement pr\u00e9c\u00e9dent a d\u00e9clar\u00e9 que la politique de ce dernier avait gaspill\u00e9 700 millions de livres sterling d'argent des contribuables pour envoyer quatre volontaires au Rwanda.<\/p>\n

Les relations entre la Grande-Bretagne et le Rwanda se sont d\u00e9t\u00e9rior\u00e9es l'an dernier lorsque Londres a suspendu une partie de son aide en raison du r\u00f4le du Rwanda dans la guerre en cours en R\u00e9publique d\u00e9mocratique du Congo. Le Rwanda subit des pressions internationales suite aux accusations de soutien au groupe rebelle M23 dans l'est du Congo.<\/p>\n

Kigali nie soutenir le mouvement M23 et accuse les forces congolaises et burundaises d'\u00eatre responsables des combats qui ont fait des milliers de morts et des centaines de milliers de d\u00e9plac\u00e9s l'an dernier.<\/p>\n

L'accord d'asile entre le Royaume-Uni et le Rwanda a \u00e9t\u00e9 l'une des politiques d'immigration les plus controvers\u00e9es d'Europe ces derni\u00e8res ann\u00e9es, avant d'\u00eatre abrog\u00e9 en 2024. Annonc\u00e9 initialement en avril 2022 sous le gouvernement de Boris Johnson, cet accord pr\u00e9voyait le transfert au Rwanda de certains demandeurs d'asile entr\u00e9s irr\u00e9guli\u00e8rement en Grande-Bretagne afin que leurs demandes y soient examin\u00e9es. S'ils obtenaient le statut de r\u00e9fugi\u00e9, ils devaient r\u00e9sider au Rwanda et non au Royaume-Uni.<\/p>\n

L\u2019objectif \u00e9tait de dissuader les migrations irr\u00e9guli\u00e8res \u00e0 travers la Manche, de lutter contre les r\u00e9seaux de passeurs et de r\u00e9duire la pression sur le syst\u00e8me d\u2019asile britannique. Cependant, ce plan s\u2019est heurt\u00e9 \u00e0 de vives objections de la part des organisations de d\u00e9fense des droits humains et du Haut-Commissariat des Nations Unies pour les r\u00e9fugi\u00e9s, qui estimaient que le transfert des demandeurs d\u2019asile vers un pays tiers soulevait des probl\u00e8mes juridiques et humanitaires et contrevenait aux principes internationaux de protection des r\u00e9fugi\u00e9s.<\/p>\n

En 2023, la Cour supr\u00eame britannique a jug\u00e9 le plan, dans sa version initiale, ill\u00e9gal, ce qui a entra\u00een\u00e9 un retard dans sa mise en \u0153uvre et une refonte de l'accord entre les deux pays. Apr\u00e8s la victoire de Keir Starmer aux \u00e9lections de 2024, le nouveau gouvernement a annonc\u00e9 l'annulation pure et simple du projet rwandais et l'arr\u00eat des travaux, le jugeant co\u00fbteux et inefficace. Cette d\u00e9cision faisait suite \u00e0 des rapports officiels britanniques r\u00e9v\u00e9lant que Londres avait vers\u00e9 des centaines de millions de livres sterling au Rwanda dans le cadre de cet accord, alors qu'aucun demandeur d'asile n'avait \u00e9t\u00e9 expuls\u00e9 de force et que le probl\u00e8me se limitait \u00e0 un tr\u00e8s petit nombre de personnes ayant d\u00e9m\u00e9nag\u00e9 volontairement.<\/p>","protected":false},"excerpt":{"rendered":"
