Il est revenu Parlement ghan\u00e9en<\/a> Le d\u00e9bat sur les droits des homosexuels a refait surface apr\u00e8s qu'il a approuv\u00e9 un projet de loi imposant des peines de prison pour les relations entre personnes de m\u00eame sexe et pour ceux qui promeuvent ou soutiennent les activit\u00e9s LGBTQ+.<\/p>\n

Le Parlement ghan\u00e9en s'attaque \u00e0 la communaut\u00e9 LGBTQ+ avec une loi stricte qui attend la signature du pr\u00e9sident. Une loi restrictive est en attente de la signature pr\u00e9sidentielle.<\/h3>\n

Le Parlement ghan\u00e9en a adopt\u00e9 l'une des lois anti-LGBT les plus restrictives d'Afrique, relan\u00e7ant une l\u00e9gislation controvers\u00e9e qui impose des peines de prison pour les relations homosexuelles et soutient les activit\u00e9s LGBT, malgr\u00e9 les vives critiques des groupes de d\u00e9fense des droits humains et des organisations internationales.<\/p>\n

Le Parlement ghan\u00e9en a approuv\u00e9 vendredi le projet de loi sur les droits sexuels et les valeurs familiales, une mesure largement consid\u00e9r\u00e9e comme l'une des lois anti-gays et transgenres les plus restrictives d'Afrique.<\/p>\n

Le premier vice-pr\u00e9sident du Parlement, Bernard Ahyapor, a d\u00e9clar\u00e9 dans son discours au Parlement que le projet de loi de 2025 sur les droits sexuels et les valeurs familiales avait \u00e9t\u00e9 adopt\u00e9 par vote \u00e0 main lev\u00e9e apr\u00e8s que le Comit\u00e9 des affaires constitutionnelles et juridiques ait recommand\u00e9 \u00e0 l'unanimit\u00e9 son adoption.<\/p>\n

Le projet de loi a \u00e9t\u00e9 pr\u00e9sent\u00e9 l'an dernier, peu apr\u00e8s l'entr\u00e9e en fonction du pr\u00e9sident John Dramani Mahama. Des chefs religieux et d'autres partisans du texte ont exhort\u00e9 les parlementaires du Congr\u00e8s national d\u00e9mocratique, le parti politique de Mahama, \u00e0 voter en sa faveur. Mahama sera d\u00e9sormais soumis \u00e0 des pressions pour le promulguer.<\/p>\n

Les l\u00e9gislateurs avaient adopt\u00e9 une version ant\u00e9rieure du projet de loi en 2024, sous le pr\u00e9d\u00e9cesseur de Mahama, le pr\u00e9sident Nana Akufo-Addo, mais celui-ci avait fait l'objet de contestations judiciaires et Akufo-Addo ne l'avait pas promulgu\u00e9.<\/p>\n

Le projet de loi modifie \u00e9galement la loi ghan\u00e9enne sur l\u2019extradition de 1960 afin de rendre extradables les infractions \u00e9num\u00e9r\u00e9es dans la nouvelle loi.<\/p>\n

L\u2019Afrique de l\u2019Ouest a connu une s\u00e9rie de lois anti-gays et anti-transgenres ces derniers mois.<\/p>\n

En mars, le pr\u00e9sident s\u00e9n\u00e9galais Bassirou Diom\u00e8ne Faye a sign\u00e9 une loi qui double la peine maximale de prison pour les actes homosexuels, la portant \u00e0 10 ans, et criminalise toute tentative de promotion de l'homosexualit\u00e9.<\/p>\n

En septembre de l'ann\u00e9e derni\u00e8re, les l\u00e9gislateurs du Burkina Faso ont vot\u00e9 pour la premi\u00e8re fois la criminalisation des relations sexuelles entre personnes de m\u00eame sexe et la criminalisation des \u201c comportements susceptibles de promouvoir les pratiques homosexuelles et similaires \u00bb.<\/p>\n

Le texte l\u00e9gislatif doit d\u00e9sormais \u00eatre ratifi\u00e9 par le pr\u00e9sident John Mahama avant de pouvoir entrer en vigueur.<\/p>\n

Les l\u00e9gislateurs avaient adopt\u00e9 le projet de loi \u00e0 l'unanimit\u00e9 en 2024, mais l'ancien pr\u00e9sident Nana Akufo-Addo ne l'a pas sign\u00e9 avant de quitter ses fonctions, ce qui a entra\u00een\u00e9 sa caducit\u00e9 en vertu des r\u00e8gles constitutionnelles.<\/p>\n

Des peines de prison pour relations homosexuelles et plaidoyer<\/h3>\n

La loi pr\u00e9voit des peines de prison allant jusqu'\u00e0 trois ans pour les personnes ayant des relations homosexuelles.<\/p>\n

La loi pr\u00e9voit \u00e9galement des peines allant de trois \u00e0 cinq ans pour les personnes reconnues coupables d'avoir promu, parrain\u00e9 ou soutenu intentionnellement des activit\u00e9s LGBTQ+.<\/p>\n

Elle interdit \u00e9galement de \u201c financer, parrainer ou promouvoir \u201d toute activit\u00e9 homosexuelle ou LGBTQ+, avec des peines de prison allant de trois \u00e0 cinq ans.<\/p>\n

La loi exige que ceux qui se livrent \u00e0 cette activit\u00e9 la signalent \u00e0 un agent de police ou \u00e0 toute autre autorit\u00e9 comp\u00e9tente, les contrevenants \u00e9tant passibles d'une peine d'emprisonnement pouvant aller jusqu'\u00e0 trois ans.<\/p>\n

Bien que la version nouvellement approuv\u00e9e conserve les dispositions essentielles du projet de loi initial, les l\u00e9gislateurs ont introduit des exceptions pour les professionnels du droit, les travailleurs de la sant\u00e9 et les professionnels des m\u00e9dias.<\/p>\n

Les organisations de d\u00e9fense des droits humains condamnent cette l\u00e9gislation<\/h3>\n

Les organisations de d\u00e9fense des droits humains et de nombreux organismes internationaux ont vivement critiqu\u00e9 ce projet de loi, arguant qu'il menace les libert\u00e9s fondamentales et pourrait accro\u00eetre la discrimination \u00e0 l'encontre des personnes LGBTQ+.<\/p>\n

Les critiques affirment que cette l\u00e9gislation menace de saper les protections offertes par la libert\u00e9 d'expression, de r\u00e9union et d'acc\u00e8s aux soins de sant\u00e9.<\/p>\n

Mais ses partisans affirment que cette mesure refl\u00e8te les valeurs culturelles et religieuses du pays.<\/p>\n

Ce d\u00e9bat refl\u00e8te un clivage social plus large.<\/h4>\n

De telles relations sont d\u00e9j\u00e0 interdites par une loi datant de l'\u00e9poque coloniale et h\u00e9rit\u00e9e de la domination britannique, m\u00eame si les poursuites judiciaires sont rares.<\/p>\n
