La controverse entourant la gr\u00e8ve des juges au Tchad a suscit\u00e9 une nouvelle vague de d\u00e9bats sur l'ind\u00e9pendance du pouvoir judiciaire et les limites des critiques adress\u00e9es aux institutions publiques, apr\u00e8s que le pr\u00e9sident tchadien Mohamed Idriss D\u00e9by a appel\u00e9 \u00e0 accepter les critiques et \u00e0 respecter la libert\u00e9 d'expression dans le cadre des lois, tout en r\u00e9affirmant son attachement au principe de s\u00e9paration des pouvoirs.<\/p>\n

Les propos du pr\u00e9sident D\u00e9by interviennent dans un contexte de tensions croissantes entre le pouvoir ex\u00e9cutif et certains acteurs du syst\u00e8me judiciaire, au sujet de positions que les juges consid\u00e8rent comme une attaque contre l'institution judiciaire, ce qui a incit\u00e9 certains d'entre eux \u00e0 entamer une gr\u00e8ve de protestation qui a suscit\u00e9 une vive r\u00e9action dans les milieux politiques et de d\u00e9fense des droits de l'homme du pays.<\/p>\n

Tensions entre le pouvoir ex\u00e9cutif et le pouvoir judiciaire au Tchad<\/h1>\n

Le pr\u00e9sident tchadien a affirm\u00e9 que la libert\u00e9 d'expression est un droit garanti \u00e0 tous, citoyens comme fonctionnaires, soulignant que la r\u00e9pression des critiques au sein des institutions peut nuire aux valeurs d\u00e9mocratiques et au contrat social. Il a ajout\u00e9 que les critiques r\u00e9centes ne visaient pas l'ensemble du syst\u00e8me judiciaire ni tous les juges, dans le but d'apaiser les tensions actuelles.<\/p>\n

Dans un message \u00e0 la dimension politique et juridique, D\u00e9by a soulign\u00e9 qu'il avait d\u00e9j\u00e0 pris des mesures pour renforcer l'ind\u00e9pendance du pouvoir judiciaire, notamment en \u0153uvrant pour emp\u00eacher le pr\u00e9sident de la R\u00e9publique de diriger le Conseil sup\u00e9rieur de la magistrature, consid\u00e9rant que cette approche refl\u00e8te sa volont\u00e9 de consacrer le principe de s\u00e9paration des pouvoirs et de garantir l'ind\u00e9pendance de l'institution judiciaire face \u00e0 toute ing\u00e9rence directe du pouvoir ex\u00e9cutif.<\/p>\n

Le pr\u00e9sident a \u00e9galement reconnu l'importance du travail syndical et son r\u00f4le dans la protection des droits professionnels, le qualifiant d'\u00e9l\u00e9ment essentiel de la pratique d\u00e9mocratique. Il a toutefois soulign\u00e9 que la d\u00e9fense d'individus ou de groupes ne devait pas justifier des positions contraires aux valeurs de la justice ou \u00e0 la d\u00e9ontologie professionnelle, faisant r\u00e9f\u00e9rence \u00e0 la controverse actuelle concernant les positions de certains syndicats de magistrats.<\/p>\n

Ces d\u00e9clarations t\u00e9moignent de la sensibilit\u00e9 de la phase actuelle au Tchad concernant la restructuration des relations entre les institutions \u00e9tatiques, notamment face aux demandes croissantes de garantie de l'ind\u00e9pendance du pouvoir judiciaire et du respect des libert\u00e9s fondamentales.
