La sc\u00e8ne politique sud-africaine est t\u00e9moin d'un nouveau d\u00e9veloppement sur la question de \u201cFarmgate<\/strong><\/a> Ce qui a r\u00e9cemment suscit\u00e9 une vive controverse, apr\u00e8s que le pr\u00e9sident Cyril Ramaphosa a intent\u00e9 une action en justice pour contester un rapport parlementaire qui rouvrait la possibilit\u00e9 de sa destitution.<\/p>\n

La Cour constitutionnelle ouvre la voie \u00e0 un r\u00e9examen des proc\u00e9dures de destitution.<\/h2>\n

\u00a0La d\u00e9cision de Ramaphosa intervient dans un contexte de pol\u00e9mique croissante autour des all\u00e9gations li\u00e9es \u00e0 la d\u00e9couverte d'argent liquide sur sa ferme priv\u00e9e en 2020, ainsi qu'aux enqu\u00eates et interpr\u00e9tations contradictoires qui ont suivi, ramenant la question au premier plan de la sc\u00e8ne politique et judiciaire du pays.<\/p>\n

Le pr\u00e9sident sud-africain Cyril Ramaphosa a d\u00e9pos\u00e9 une plainte visant \u00e0 faire annuler un rapport command\u00e9 par le Parlement qui a rouvert la possibilit\u00e9 d'une proc\u00e9dure de destitution \u00e0 son encontre.<\/p>\n

La requ\u00eate de Ramaphosa aupr\u00e8s de la Haute Cour du Cap all\u00e8gue que la commission ind\u00e9pendante qui a produit le rapport Farmgate de 2022 \u201c a mal compris son mandat, a mal \u00e9valu\u00e9 les informations qui lui ont \u00e9t\u00e9 fournies et a mal interpr\u00e9t\u00e9 les quatre accusations \u201d port\u00e9es contre le pr\u00e9sident.<\/p>\n

Le rapport conclut que Ramaphosa pourrait avoir commis une faute grave en lien avec le vol de 580\u00a0000 dollars am\u00e9ricains cach\u00e9s dans un canap\u00e9 de sa ferme de chasse \u00e0 Vala Vala, dans le Limpopo, en 2020.<\/p>\n

La l\u00e9gislation sud-africaine sur les changes stipule que ces liquidit\u00e9s doivent \u00eatre d\u00e9pos\u00e9es aupr\u00e8s d'un \u00e9tablissement agr\u00e9\u00e9 dans un d\u00e9lai de 30 jours, mais Ramaphosa a insist\u00e9 sur le fait que l'argent provenait de la vente d'un projet d'\u00e9levage de buffles et a ni\u00e9 avoir viol\u00e9 son serment d'office.<\/p>\n

Le comit\u00e9 a expliqu\u00e9 qu'il avait \u201c un dossier qui n\u00e9cessite une r\u00e9ponse \u201d, ce qui a suscit\u00e9 des appels \u00e0 une enqu\u00eate sur sa destitution.<\/p>\n

Le Parlement, alors contr\u00f4l\u00e9 par la majorit\u00e9 ANC, a vot\u00e9 en 2022 contre la cr\u00e9ation d'une commission de responsabilit\u00e9, mais la Cour constitutionnelle a statu\u00e9 plus t\u00f4t ce mois-ci que cette d\u00e9cision \u00e9tait inconstitutionnelle, ouvrant la voie \u00e0 un r\u00e9examen de la question par les parlementaires.<\/p>\n

Depuis que le Congr\u00e8s national africain a perdu sa majorit\u00e9 lors des \u00e9lections g\u00e9n\u00e9rales de 2024, il gouverne par le biais d'une coalition, ce qui accro\u00eet l'incertitude quant au d\u00e9roulement possible d'une nouvelle proc\u00e9dure de destitution.<\/p>\n

Suite \u00e0 la r\u00e9cente d\u00e9cision de justice, le pr\u00e9sident du Parlement a form\u00e9 une commission de destitution de 31 membres repr\u00e9sentant 16 partis politiques, dont neuf d\u00e9put\u00e9s du Congr\u00e8s national africain.<\/p>\n

Le comit\u00e9 est charg\u00e9 de d\u00e9terminer s'il existe des motifs pour engager une proc\u00e9dure de destitution.<\/p>\n
