The UN Special Rapporteur on Territories said Occupied Palestinian<\/a>Francesca Albanese said that India \u201cis violating its obligations under international law and may be facing liability\u201d because of its continued relations and support for Israel in the context of the war on Gaza.<\/p>\n

In an interview with The Hindu, Albanese stressed that \u201cthe legal responsibilities are clear,\u201d emphasizing that the International Court of Justice declared the occupation illegal and imposed an explicit obligation on states \u201cnot to trade, not to transfer arms, and not to purchase arms from a state accused of maintaining an illegal occupation.\u201d.<\/p>\n

She added in a decisive tone: \u201cWithin this framework, India is violating its obligations under international law, and may also be facing liability.\u201d.<\/p>\n

Unambiguous legal obligations<\/strong><\/p>\n

Albanese stressed that the obligations of third countries \u201care not a matter of choice,\u201d but a direct legal obligation, noting that the seriousness of the situation is compounded \u201cin the context of a genocide currently being considered by the International Court of Justice.\u201d.<\/p>\n

She also pointed out that Israeli Prime Minister Benjamin Netanyahu is \u201caccused of war crimes and crimes against humanity,\u201d which makes any support for him \u201cpotentially subject to legal accountability.\u201d.<\/p>\n

She stated clearly: \u201cCountries that support Israel in ways that harm Palestinians could face legal scrutiny and, under appropriate circumstances, accountability.\u201d.<\/p>\n

Direct accusations regarding weapons<\/strong><\/p>\n

Regarding India, Albanese referred to reports indicating continued exports military components<\/a> To Israel, saying that \u201cproviding weapons or any form of support contributes to the continuation of this illegal situation.\u201d.<\/p>\n

Reports, including those from Al Jazeera, indicated that Indian companies continued to export missiles, explosives, and military components during the war.<\/p>\n

Nevertheless, India\u2019s Supreme Court rejected a petition to halt these exports, a move that critics say reinforces the continuation of this trend.<\/p>\n

A radical critique of the Indian role<\/strong><\/p>\n

In a reading that goes beyond law to politics and history, Albanese said: \u201cIndia and Israel, or historical Palestine, share the fact that their formation was influenced by British colonialism.\u201d.<\/p>\n

She added: \u201cBoth emerged from British colonialism. Israel was established within Palestine during that period, and today it is a member of the United Nations, and it must act accordingly. And India too.\u201d.<\/p>\n

But she returned to emphasize in a sharply critical tone: \u201cIt seems to me that India and Israel are contributing today to the erosion of the international order that our ancestors painstakingly built.\u201d.<\/p>\n

\u201cA systematic collapse of the international order\u201d<\/strong><\/p>\n

Albanese broadened her criticism to include what she described as the international system's slide toward "illegitimacy," saying that figures like Donald Trump and Netanyahu "are twisting the arm of the system, pushing to make lawlessness so widespread and systematic that it has become contagious.".<\/p>\n

\"\"<\/p>\n

She also stressed that \u201cresponsibility is not limited to states,\u201d adding: \u201cThere is also criminal responsibility on individuals who authorize or approve of such policies.\u201d.<\/p>\n

She pointed to legal actions in countries such as Italy targeting government officials over their support for Israel.<\/p>\n

A moral responsibility that is "no less serious"\u201c<\/strong><\/p>\n

Albanese stressed that \u201cthere is something no less serious than legal responsibility, which is moral responsibility,\u201d considering India\u2019s current position to be \u201cworrying\u201d given its history of resisting colonialism.<\/p>\n

She stated bluntly: \u201cThere seems to be a betrayal of that past in India\u2019s association with Israel,\u201d adding that its leaders \u201chave chosen to stand on the other side.\u201d.<\/p>\n

UN report: \u201cA systematic torture environment\u201d<\/strong><\/p>\n

In her latest report to the Human Rights Council, entitled \u201cTorture and Genocide\u201d, Albanese concluded that Israel has been \u201cpracticing systematic torture\u201d against Palestinians since October 2023.<\/p>\n

She described Gaza as a \u201cvast torture camp,\u201d asserting that the Israeli authorities \u201cengineered a torture environment aimed at breaking resistance, dignity, and resilience.\u201d.<\/p>\n

The report documented more than 18,500 arrests, including about 1,500 children, and more than 4,000 enforced disappearances, along with the use of surveillance technologies such as facial recognition and drones to impose a \u201cpermanent climate of fear.\u201d.<\/p>\n

He also pointed to the torture of more than 50 UNRWA employees, the targeting of doctors, journalists and activists, in addition to accusations of prison doctors colluding in falsifying medical records.<\/p>\n

Towards international accountability?<\/strong><\/p>\n

Albanese concluded that \u201cthe scale and nature of these acts, including those occurring outside detention centers, rise to the threshold of genocide,\u201d within the context of a broader system of apartheid and settler colonialism.<\/p>\n

In light of this, the question remains open: Will these warnings turn into actual legal paths that affect the supporting countries, especially India, or will the international system \u2013 as Albanese describes it \u2013 continue its slide towards further erosion?<\/p>","protected":false},"excerpt":{"rendered":"
