In a landmark ruling, South Africa’s Constitutional Court ruled that parliament acted unconstitutionally when it halted efforts to initiate impeachment proceedings against President Cyril Ramaphosa in 2022.

This ruling came in the wake of a legal challenge brought by opposition parties, who claimed that lawmakers had unlawfully obstructed a process intended to examine serious allegations against the head of state.

The details of the case go back to the recommendations of a panel of legal experts who previously found that Ramaphosa may have a case to answer, in connection with a controversial burglary at his rural estate, in which more than $500,000 in cash was reportedly stolen and hidden inside a sofa.

The incident sparked widespread controversy at the time, with questions raised about the source of the funds and the extent of compliance with disclosure requirements, while President Ramaphosa denied any wrongdoing, stressing that he acted within the framework of the law.

The impeachment proceedings were later halted following a parliamentary vote in which his party, the African National Congress, then held a majority in parliament, a majority which it has since lost in subsequent elections.

The court's decision now opens the door for a parliamentary review of the impeachment process, reinforcing the constitutional requirement that such proceedings should not be politically obstructed once they have been properly initiated.
